Most 1031 sites are either QI (Qualified Intermediary) sites or listing brokers, or DST (Delaware Statutory Trust) Specialists. This is the only site that is focused 100% on the best interest of the investor/exchanger, including true buyer representation versus dual agency. Being represented in a dual agency situation is not ideal; while you will be treated fairly, the listing broker is purely focused on pleasing their sellers. Moreover, these agents/brokers/specialists often have little to no interest in sharing other exchange options (and there are many!) other than traditional, fee simple real estate transactions.
As with most investment opportunities, a 1031 Tax Deferred Exchange is not a “one size fits all” transaction. Many sellers might still be deciding if a 1031 makes sense for them while their “down-leg property” (currently owned) is already listed, or even in escrow and about to become relinquished property. Before any commercial property is put on the market, all options must be carefully considered and planned for, to insure the best overall outcome for the investor.
In many states, it is law that a seller be informed of the 1031 Tax Deferred Exchange tax code before close of escrow. Yet more than 80% of agents/brokers are unknowledgeable in the intricacies of a 1031 Tax Deferred Exchange. This lack of knowledge results in investors missing out on significant wealth preservation and wealth building opportunities.
